Federal Judge Orders Freedom of Abrego Garcia from ICE Detention

A court has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued confinement lacks legal authority.

"Since his return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her ruling.

The case stems from a mistaken deportation to El Salvador earlier this year, which the government later admitted was an mistake. Following his repatriation to the United States to answer human smuggling charges, he was held in immigration detention.

In her order, the court noted that the authorities does not have a valid deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."

Context of the Legal Challenge

The court challenge center on disputed assertions. While the Trump administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently denies this allegation.

He has also pleaded not guilty to the smuggling charges, which are part of a ongoing trial in Tennessee.

The court, who was hearing his challenge to removal in a federal court, determined that he must now adhere to the terms of his bond from jail in Tennessee. This order shifts his supervision to the jurisdiction handling his criminal case.
